Accessing and using the website www.noatec.co (hereinafter «the Site») constitutes full and unconditional acceptance of these Terms and Conditions of Use (hereinafter «the Terms»). If you do not agree with any of them, you must refrain from using the Site.

These Terms apply to all visitors, users and any other persons who access the Site or use the services provided by Noatec S.A.S.

The purpose of the Site is to present the technology products and services of Noatec S.A.S., in particular the Index AMI HW3 device (4G IoT gateway for AMI smart metering), and to facilitate commercial contact with potential customers, distributors and strategic partners.

The Site is not an online store and does not allow direct product purchases. Quotes and commercial proposals are handled directly by the Noatec S.A.S. sales team.

Users may use the Site exclusively to:

• Consult information about the products and services of Noatec S.A.S.
• Download technical or commercial materials expressly made available.
• Contact Noatec S.A.S. through the enabled forms and channels.
• Request product quotes for legitimate commercial or industrial use.

Use of the Site is permitted only to persons aged 18 or over, or with the legal capacity to enter into contracts in their jurisdiction.

The following are expressly prohibited:

• Reproducing, copying, distributing or publicly communicating the content of the Site without written authorisation from Noatec S.A.S.
• Using the Site for unlawful, fraudulent purposes or that infringe the rights of third parties.
• Introducing or spreading computer viruses, malicious code or any element that may damage, alter or prevent the normal operation of the Site.
• Carrying out scraping, crawling or bulk data extraction without prior written consent.
• Impersonating Noatec S.A.S. or its employees.
• Sending unsolicited communications (spam) through the Site's forms.
• Attempting to access systems, networks or databases of Noatec S.A.S. without authorisation.

All content on the Site — including, without limitation, text, graphics, logos, icons, images, audio and video files, digital downloads, data compilations and software — is the property of Noatec S.A.S. or its content providers, and is protected by Colombian and international intellectual property laws.

The Noatec® trademark, logo and associated trade names are registered trademarks of Noatec S.A.S. Unauthorised use is prohibited.

Viewing and downloading materials from the Site is authorised solely for personal, non-commercial and temporary use, provided they are not modified and intellectual property notices are maintained.

Noatec S.A.S. shall not be liable for:

• Direct, indirect, incidental or consequential damages arising from the use or inability to use the Site.
• Errors or omissions in Site content, including technical specifications which may be updated without notice.
• Interruptions, delays or failures in the operation of the Site due to causes beyond its control (force majeure, third-party failures, etc.).
• The security or privacy of information transmitted via third-party networks or systems.
• Content of third-party websites linked from the Site.

The technical specifications of the Index AMI HW3 product published on the Site are indicative only. Definitive specifications are confirmed in the formal commercial proposal.

The processing of personal data collected through the Site is governed by the Privacy and Personal Data Protection Policy of Noatec S.A.S. (code PO-PG-02).

By using the Site, the user authorises Noatec S.A.S. to process their personal data in accordance with that Policy and in compliance with Colombian Law 1581 of 2012 and Decree 1074 of 2015.

By completing any form on the Site, the user declares that the information provided is truthful, complete and up to date. Noatec S.A.S. is not responsible for any harm caused by false or inaccurate data provided.

Submitting a quote request form does not constitute a binding commercial offer and creates no contractual obligation for either party. The commercial relationship is formalised only through a signed contract or purchase order.

Noatec S.A.S. endeavours to keep the Site continuously available but does not guarantee uninterrupted availability. The Site may be temporarily suspended for maintenance, updates or force majeure without prior notice.

Noatec S.A.S. reserves the right to modify, suspend or discontinue any aspect of the Site at any time.

Noatec S.A.S. reserves the right to amend these Terms at any time. Amendments take effect from the moment they are published on the Site. Users are advised to review this page periodically.

Continued use of the Site following the publication of changes constitutes acceptance of the new Terms.

These Terms are governed by and construed in accordance with the laws of the Republic of Colombia. For the resolution of any dispute arising from the use of the Site, the parties submit to the competent courts of the city of Manizales, Colombia, waiving any other jurisdiction that may apply.

In the event of any conflict between versions of these Terms in different languages, the Spanish version shall prevail.
